Terms of Service

These Terms of Service (“Terms”) govern your use of greenstreetpropertymanagement.com (the “Site”), which is operated by Green Street Property Management Inc (“Green Street,” “we,” “us,” or “our”). By accessing or using the Site, submitting a form, or making a reservation, you agree to these Terms. If you do not agree, please do not use the Site.

Please also read our Privacy Policy, which explains how we handle your information and is incorporated into these Terms.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to make a reservation, submit a form, or opt into text messaging through the Site. By using the Site for any of these purposes, you represent that you meet these requirements.

What This Site Is

The Site provides information about our property management, leasing, and rental placement services, and allows you to browse and book vacation rental properties we manage in the San Diego area.

Descriptions of our services on the Site are general information, not an offer or a guarantee of results. Any property management, leasing, or rental placement engagement is governed exclusively by a separate written agreement signed by you and Green Street. Where these Terms conflict with a signed management agreement, lease, or rental agreement, that signed agreement controls.

Vacation Rental Listings

Listing information — including photographs, descriptions, amenities, house rules, availability, rates, taxes, and fees — is supplied through our property management system and can change at any time. We work to keep it accurate, but we do not warrant that listing content is complete, current, or error-free. Rates and availability are not confirmed until your reservation is confirmed.

Photographs and floor plans are representative. Minor differences in furnishings, decor, and views are normal. If a material error in a listing affects a confirmed reservation, we will contact you to correct it, offer a comparable alternative, or provide a refund.

Reservations and Payment

Reservations made through the Site are processed through our booking platform, Guesty. Card payments are processed by Stripe. When you submit a booking you authorize us and our processors to charge the payment method you provide for the total shown at checkout, including nightly rate, cleaning and service fees, and applicable taxes.

  • Quotes. A price quote reflects rates and availability at the moment it is generated and may expire or change before you complete your booking.
  • Confirmation. Your reservation is not final until you receive a written confirmation from us or our booking platform. Submitting a booking request does not by itself create a reservation.
  • Rental agreement and house rules. Every stay is subject to the house rules, occupancy limits, check-in and check-out times, and any rental agreement or guest verification requirements shown on the listing or provided to you after booking. Violating them may result in cancellation without refund.
  • Cancellations and refunds. Each listing displays the cancellation policy that applies to it. The policy shown on the listing at the time you book is the policy that governs your reservation. Cleaning fees, service fees, and taxes may be refundable or non-refundable depending on that policy and applicable law.
  • Changes by us. In rare cases — damage, a maintenance emergency, an owner withdrawal, or circumstances beyond our control — we may need to relocate you to a comparable property or cancel the reservation and issue a refund. A refund of amounts paid is our sole obligation in that situation.
  • Damage and additional charges. You are responsible for damage to the property and its contents beyond normal wear during your stay, and for charges incurred by exceeding the stated occupancy or violating the house rules.
  • Right to refuse. We may decline or cancel any reservation where we reasonably suspect fraud, misrepresentation, an intent to hold an event or party in violation of house rules, or a violation of law or these Terms.

Bookings made through our booking platform are also subject to that platform’s own terms, which are linked from the booking form.

Owner and Resident Portals

Rent payments, maintenance requests, rental applications, lease documents, and owner statements are handled through a third-party portal operated by our property management software provider. Those portals are not part of this Site. Your use of them is governed by that provider’s terms of service and privacy policy, and by your lease or management agreement with us.

Fair Housing

Green Street is committed to equal housing opportunity. We do business in accordance with the federal Fair Housing Act and California fair housing law, and we do not discriminate on the basis of race, color, religion, sex, gender, gender identity or expression, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, veteran or military status, genetic information, or any other characteristic protected by law.

Communications From Us

When you submit a form on the Site, you agree that we may contact you by email or phone about your inquiry. Text messages are sent only if you check one of the optional SMS consent boxes. Consent to receive text messages is never required to purchase or receive services from us. See the SMS terms at the end of this page for full details, and our Privacy Policy for how we handle your contact information.

Acceptable Use

When using the Site, you agree not to:

  • submit false, misleading, or fraudulent information, or impersonate another person;
  • use the Site for any unlawful purpose, or in violation of any applicable law or regulation;
  • scrape, crawl, harvest, or copy listing data, photographs, reviews, or contact information by automated means;
  • circumvent, disable, or interfere with security features, rate limits, or bot protection;
  • attempt to gain unauthorized access to the Site, our systems, or any related account;
  • introduce malware, or take any action that imposes an unreasonable load on our infrastructure; or
  • use the Site to send unsolicited commercial messages.

We may suspend or block access to the Site for any conduct that violates these Terms.

Intellectual Property

The Site and its contents — including text, graphics, logos, photographs, video, page design, and software — are owned by Green Street or our licensors and are protected by United States copyright and trademark law. The Green Street name and logo are our trademarks and may not be used without our prior written permission.

You may view, download, and print pages from the Site for your own personal, non-commercial use in connection with considering or arranging our services. Any other use — reproduction, republication, distribution, or the creation of derivative works — requires our prior written consent.

Reviews and Testimonials

Guest reviews and client testimonials shown on the Site reflect the experience of the individuals who wrote them. They are not a guarantee, promise, or prediction of the results you will experience. Reviews displayed on listing pages are supplied by our booking platform and the booking channels our properties appear on.

Third-Party Content and Links

The Site includes links to and content from third parties, including maps, embedded video, booking platforms, payment processing, and our profiles on social and review sites. We do not control that content and are not responsible for it. Links do not imply endorsement, and your use of any third-party service is subject to that provider’s own terms.

Accessibility

We are working to keep the Site usable by everyone, including visitors who use assistive technology. If you encounter a barrier, please see our Accessibility page or contact us so we can help and make improvements.

Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Green Street disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected. Nothing on the Site constitutes legal, tax, financial, or investment advice, and you should consult your own professional advisors before making decisions about a property.

Limitation of Liability

To the fullest extent permitted by law, Green Street and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising out of or relating to your use of the Site, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or these Terms will not exceed the greater of the amount you paid us for the reservation giving rise to the claim, or one hundred dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by law, and nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to indemnify and hold harmless Green Street and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, your violation of any law, or your infringement of the rights of any third party.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to first contact us at sales@gs-pm.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms. The Terms in effect at the time you make a reservation govern that reservation.

General

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy and any signed agreement between us, are the entire agreement between you and Green Street regarding the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.

Green Street Property Management Inc SMS/Text Messaging Terms & Conditions

Program Description

By providing your mobile number and opting in through website forms, you agree to receive text messages from Green Street Property Management Inc. These messages may include transactional communications (such as rental updates, account notifications, and service information) as well as occasional promotional or marketing messages about property management services. Message frequency may vary.

Opt-In Consent

By submitting your phone number via the website, you consent to receive text messages from Green Street Property Management Inc at the number provided. Consent is not required as a condition of purchasing or receiving services. To use the SMS service, you must be 18+.

Message and Data Rates

Message and data rates may apply to each text message sent or received, as provided in your wireless service rate plan. Please contact your wireless carrier for pricing details.

Opt-Out Instructions

You may opt out at any time by replying STOP to any Green Street Property Management Inc message. After you send “STOP,” we will confirm your opt-out, and you will no longer receive SMS messages unless you opt back in.
